Terms of Service

By downloading, installing, or using the Realm Money mobile application ("App") or website ("Service") provided by Beyond The Horizon Innovations ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms").

These Terms constitute a legally binding agreement between you and Beyond The Horizon Innovations. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

To use Realm Money, you must:

• Be at least 18 years of age
• Be a resident of Kenya or have a valid Kenyan M-PESA-enabled phone number
• Have a valid Google account for sign-in
• Have a compatible Android device (Android 6.0 / API 23 or higher)
• Not be prohibited from using financial services under any applicable law

You sign in to Realm Money using your Google account. By doing so, you authorize us to access your Google profile information (name, email, profile picture) as described in our Privacy Policy.

You will be required to set a 4-digit PIN for transaction authorization. You are solely responsible for:

• Maintaining the confidentiality of your PIN
• All activities that occur under your account
• Immediately notifying us of any unauthorized use of your account

You must not share your PIN with anyone, including Realm Money staff. We will never ask for your PIN.

Goal Creation: You may create personal or group savings goals within the App. You are responsible for the accuracy of goal information you provide.

Goal Locking: When you lock a goal until a specific date, withdrawal restrictions are enforced by the App. While we make every effort to maintain these restrictions, you acknowledge that system errors or exceptional circumstances may affect locked goals.

Group Goals: When you invite others to a group goal, you agree that all participants can view contribution amounts and goal balances. You are responsible for managing member access to your group goals.

Balances: Realm Money displays your savings balances in real-time. We are not responsible for delays in balance updates caused by M-PESA or SasaPay system outages.

All financial transactions (deposits and withdrawals) are processed through SasaPay, a licensed payment service provider, and Safaricom's M-PESA platform. By making transactions through the App, you also agree to SasaPay's and Safaricom's terms of service.

• Deposits: Funds deposited into a goal are processed via M-PESA STK push. Deposits are typically credited instantly upon successful M-PESA confirmation.
• Withdrawals: Withdrawals are processed to your registered M-PESA phone number. Processing may take up to 24 hours in exceptional circumstances.
• Transaction Fees: Standard M-PESA transaction charges from Safaricom apply. Realm Money does not charge additional fees for deposits or withdrawals.
• Failed Transactions: In the event of a failed transaction where funds have been debited from M-PESA but not credited to your goal, contact us immediately at support@realmoney.app with transaction details.

We are not liable for delays, failures, or errors caused by M-PESA or SasaPay systems.

You agree not to use Realm Money to:

• Engage in money laundering, fraud, or any illegal financial activity
• Process funds obtained through illegal means
• Circumvent or attempt to circumvent any anti-money laundering (AML) controls
• Create accounts on behalf of others without their explicit consent
• Attempt to hack, reverse-engineer, or compromise the App's security
• Violate any applicable Kenyan laws or regulations
• Use the App for any purpose other than personal savings management

Violation of these prohibited uses may result in immediate account suspension, legal action, and reporting to relevant Kenyan authorities.

The Realm Money App, website, logo, design, code, and all content are the exclusive property of Beyond The Horizon Innovations and are protected by Kenyan and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App solely for personal, non-commercial savings management purposes. You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer or attempt to extract the source code
• Create derivative works based on the App

Realm Money is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or completely secure
• Warranties regarding the accuracy or reliability of App content

We do not provide investment advice. Realm Money is a savings management tool only — nothing in the App constitutes financial, legal, or investment advice.

To the maximum extent permitted by Kenyan law, Beyond The Horizon Innovations shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the total amount of fees paid by you to us in the 12 months preceding the claim (which, since the App is free, may be zero).

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

You may delete your account at any time through the App settings or by contacting us at support@realmoney.app.

We reserve the right to suspend or terminate your account without notice if we reasonably believe you have:

• Violated these Terms
• Engaged in fraudulent or illegal activity
• Provided false or misleading information

Upon termination, your access to the App will cease immediately. Any funds in your goals will be processed for return to your registered M-PESA number within 14 business days, less any applicable transaction fees.

These Terms are governed by the laws of Kenya. Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation.

If a dispute cannot be resolved informally within 30 days, it shall be submitted to arbitration in Nairobi, Kenya, under the Arbitration Act of Kenya (Cap 49).

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the App or by email at least 14 days before the changes become effective.

Your continued use of the App after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
